La sentenza, pronunciata ieri dal Gup Marina Finiti, ha introdotto per la prima volta in Italia l'elemento della volontarietà in un contesto da sempre considerato colposo. Si pensa, ovvero, che l'imputato sia stato chiaramente "irresponsabile", ma che non avesse certo esplicita "intenzione" di uccidere qualcuno.

Sono sicuro che Lucidi non voleva ammazzare quei poveretti. Cosa però si debba intendere per "irresponsabilità", "intenzione", e "volontà" rimane un problema eticamente lungi dall'essere assodato.
Esiste una casistica, lunghissima, inesauribile, di morti causate da una guida condizionata dall'uso di droghe e/o alcool. Non c'è modo di negare che il consumo di queste sostanze sia directly linked to these deaths.
